IMPLEMENTASI PENGALIHAN HAK TANAH BENGKOK DALAM PERSPEKTIF GOOD VILLAGE GOVERNANCE DI DESA BIBIS, MAGETAN

Abstract

Bengkok land has historically served as a form of compensation for village heads and village officials in carrying out their governmental duties. bengkok land became part of village assets and must be managed in accordance with the principles of Good Village Governance. This study aims to analyze the implementation of the transfer of bengkok land utilization rights to village officials in Bibis Village and assess its conformity with the principles of Good Village Governance. This research employs a socio-legal approach, combining statutory and empirical approaches through a case study conducted in Bibis Village. The findings indicate that the transfer of utilization rights remains position-based. However, its implementation is constrained by weak asset administration, limited legal certainty, and the absence of standardized procedures for the return of utilization rights upon the expiration of office. From the perspective of Good Village Governance, the management of bengkok land in Bibis Village has not fully reflected the principles of transparency, accountability, and the rule of law. Therefore, strengthening village asset administration, establishing clear procedures for transferring utilization rights, enhancing oversight by the Village Consultative Body, and encouraging community participation are necessary to achieve transparent, accountable, and public-oriented village asset governance.
