Abstract

Surabaya City, as a disaster-prone area, has issued Mayor Regulation of Surabaya Number 115 of 2021 concerning Disaster Management. However, Article 4 of the regulation shows inconsistencies with higher legislation, namely Law Number 24 of 2007 on Disaster Management and Government Regulation Number 21 of 2008 on Disaster Management Implementation. This study aims to analyze the normative conformity of Article 4 and evaluate the legal implications and its impact on the implementation of disaster management in Surabaya.

The research method used is normative juridical with a statute and conceptual approach. The findings show that Article 4 of the Mayor Regulation does not comprehensively include key elements such as preparedness, early warning, and disaster risk reduction, as mandated by higher laws. These inconsistencies create legal ambiguity, regulatory gaps, and vertical conflicts. Practically, Surabaya’s Disaster Management Agency (BPBD) lacks a strong legal foundation in decision-making, inter-agency coordination is weakened, and community involvement in preparedness remains low. Therefore, revision and harmonization of the Mayor Regulation are needed to align with the principles of proper legislative drafting and to ensure an effective local disaster management system.
