Abstract

This study examines the legalization of marijuana in Indonesia from a legal perspective, focusing on the potential medical benefits of marijuana amidst existing regulations. Marijuana is classified as a narcotic under Law No. 35 of 2009, which strictly regulates narcotics control. However, public sentiment regarding marijuana, especially its use in traditional medicine, creates complexities in the implementation of the law in Indonesia. This study reviews the historical context of marijuana use and its role in traditional medicine practices that have long been known in society. In addition, this study highlights the ongoing debate about the therapeutic application of marijuana as an alternative treatment that has the potential to provide health benefits. This study also compares the situation in Indonesia with several other countries that have successfully legalized marijuana for medical purposes, thus providing an overview of how regulation and legal implementation can run effectively without neglecting aspects of public safety and health. The main objective of this study is to contribute to the discourse on narcotics law reform in Indonesia, especially in order to accommodate the medical use of marijuana. Thus, this study is expected to be an important reference for policy makers, academics, and the general public in understanding the legal and medical implications of marijuana legalization, as well as helping to find a balance between public health interests and existing legal regulations.
