PENGATURAN PENYELESAIAN PENGUASAAN TANAH ANTARA WARGA PEMEGANG IZIN PEMAKAIAN TANAH (IPT) DENGAN PEMERINTAH KOTA SURABAYA

This research discusses the regulatory framework and dispute resolution mechanisms concerning land control between residents holding Land Use Permits (Izin Pemakaian Tanah or IPT) and the Surabaya City Government. Within the context of Indonesian agrarian law, IPT is a form of permit granted by local governments to individuals or legal entities to utilize state-owned land. Over time, legal issues often arise between IPT holders and the city government, particularly regarding the legal status of the land, the continuity of the permit, and the transfer of land rights.
The aim of this study is to analyze the legal regulations governing IPT in Surabaya, to understand the mechanisms for resolving land control disputes between residents and the city government, and to examine the factors that hinder effective resolution. This research employs a normative juridical approach supported by empirical data collected through interviews with relevant stakeholders.
The findings indicate that although IPT is regulated through local regulations and internal policies of the Surabaya City Government, legal gaps remain, causing uncertainty in land tenure. Dispute resolution is commonly pursued through administrative mediation, although some cases proceed to litigation. Strengthening regulations and increasing transparency in the IPT issuance and renewal processes are essential to ensure legal certainty for the public.
