TINJAUAN YURIDIS TERHADAP PENGATURAN MINUMAN BERALKOHOL PADA PERATURAN DAERAH KOTA SURABAYA NOMOR 1 TAHUN 2023 TENTANG PERDAGANGAN DAN PERINDUSTRIAN

Abstract

        This research identifies and analyzes the legal framework of alcoholic beverage regulations in Surabaya, specifically focusing on the Regional Regulation of Surabaya City Number 1 of 2023. The study is driven by the urgent need to address the social, health, and security impacts of alcohol distribution in a major metropolitan area while ensuring legal certainty for business actors. Using a normative legal research method with statutory and conceptual approaches, this study examines the consistency of local norms with higher-level national regulations. The findings reveal that the regulation introduces a more structured classification and a risk-based licensing mechanism, aligning with the Job Creation Law framework. However, the effectiveness of these norms is challenged by the persistence of informal distribution channels and the need for rigorous administrative supervision. The study concludes that while the regulation provides a solid legal basis for public order, enhanced inter-agency coordination is required to mitigate illegal trade. This research offers recommendations for the Surabaya City Government to optimize enforcement through both administrative sanctions and public education.
