Abstract

This study examines the dynamics of water resource governance in Surabaya, focusing on the conflict of interest between PDAM Surya Sembada and elite housing developers in West and South Surabaya. The research is driven by the phenomenon of independent water management by developers, which remains unintegrated with the PDAM network. This practice raises critical legal concerns regarding Article 33 of the 1945 Constitution, creates service disparities between elite residents and the general public, and threatens Regional Original Income (PAD). Using a qualitative approach involving hearing mechanisms and field observations, the study analyzes the conflict’s regulatory, economic, and technical roots while evaluating the Surabaya City DPRD’s supervisory effectiveness. The findings reveal that while developers seek to maintain exclusive service standards, such autonomy violates principles of social justice and state water sovereignty. In response, the DPRD’s Commission A facilitated mediation through Public Hearings (RDP). The study concludes that the enactment of Surabaya City Regulation No. 1 of 2025 serves as a strategic solution, mandating service integration into the PDAM network to ensure community rights and legal certainty in public utility management.
