Abstract

The Prosecutor's effort in restorative justice at the Pasuruan District Attorney's Office is aimed at creating a sense of justice and humanity, prioritizing the interests of victims and suspects to reach a mutual agreement in seeking resolution to the crime of bird theft and its implications by emphasizing restoration rather than retaliation. The purpose of this research is to examine and analyze the process of implementing restorative justice in handling bird theft cases at the Pasuruan District Attorney's Office and to analyze what supporting factors exist during the implementation process of restorative justice in the handling of bird theft cases at the Pasuruan District Attorney's Office to ensure a smooth process. The method applied in this paper is the empirical legal research method, which involves observing how facts occur in the field or in society, allowing the researcher to more easily obtain data in the field as expected in the research..Data obtained from interviews with several sources and obtained from journal references obtained through the internet and laws and regulations. The results of this study indicate that the implementation of Restorative Justice in the crime of theft at the Pasuruan City District Attorney's Office is running smoothly. Because there are supporting factors for the completion of the implementation of Restorative Justice. The supporting factors during the implementation of restorative justice run smoothly include the ability of the facilitator to approach the parties and the existence of supporting factors, namely the facilitator and the victim who are heartened.
