THE IMPLEMENTATION OF RESTORATIVE JUSTICE IN THE SETTLEMENT OF DOMESTIC VIOLENCE CASES AT POLRESTA SIDOARJO

This study discusses the implementation of Restorative Justice in resolving Domestic Violence cases at the Sidoarjo City Police. The main issue addressed is the absence of Restorative Justice application in handling Domestic Violence cases, despite existing police regulations providing space for non-litigation resolutions. The research uses a juridical-sociological method with a qualitative approach through interviews with victims who withdrew their complaints and investigators. The findings show that the withdrawal of reports by victims is mostly influenced by economic dependence, internal family relationships, and the perception that the perpetrator’s actions were forgivable. Additionally, investigators did not offer the Restorative Justice alternative due to limited personnel and lack of internal socialization regarding the new regulations. This study concludes that internal reinforcement within the police and public education on legal alternatives are necessary to implement Restorative Justice effectively.
