IMPLEMENTASI KELEMBAGAAN PARALEGAL SECARA STRUKTURAL GUNA MENDUKUNG RESOLUSI KONFLIK TINGKAT DESA (STUDI KASUS DESA BIBIS)

Abstract

This study aims to examine the dispute resolution patterns currently employed by 

village officials and to formulate a structural design for institutionalizing village 

paralegals to strengthen conflict resolution at the village level, focusing on Bibis 

Village, Sukomoro District, Magetan Regency. The research employs an empiricaljuridical method with a case study approach covering four types of disputes: minor 

assault, potential religious-based friction, alleged infidelity, and disputes regarding 

the use of village-owned land (*tanah bengkok*). Findings indicate that the Bibis 

Village Government has not yet issued a Village Head Decree regarding the 

establishment of a Village Paralegal Post nor developed written Standard Operating 

Procedures (SOPs) for mediation; consequently, dispute resolution has relied on 

village officials acting as functional paralegals who utilize a familial approach and 

local leadership discretion. While this pattern has proven effective in mitigating 

conflict at the micro-level, the lack of formal legitimacy creates potential for legal 

uncertainty and limitations on authority in specific cases. The study recommends the 

structured institutionalization of a Village Paralegal Post through the issuance of a 

Village Head Decree and the formulation of Village Mediation SOPs to strengthen the 

application of restorative justice and ensure legal certainty and sustainable peace at 

the village level.
