ANALISIS PASAL 103 AYAT (4) HURUF E PP NOMOR 28 TAHUN 2024 MENGENAI PENYEDIAAN ALAT KONTRASEPSI TERHADAP MORALITAS BANGSA

Abstract

The phrase “provision of contraceptives” in Article 103 paragraph (4) letter e of Government Regulation Number 28 of 2024 concerning the Implementation of Law Number 17 of 2023 concerning Health has sparked debate because of the phrase “provision.” The ambiguity of this phrase has the potential to cause inconsistency with the objectives of national education as stipulated in Article 3 of Law Number 20 of 2003 concerning the National Education System, which emphasizes the character, moral, and ethical development of students. This study uses a normative legal research method with a legislative approach to analyze the alignment of these provisions with the education legal system and moral values that apply in society. The results of the study indicate that the phrase “provision of contraceptives” in PP No. 28 of 2024 has the potential to conflict with national education objectives if it is not clearly formulated. Therefore, it is necessary to harmonize the norms with Minister of Health Regulation No. 2 of 2025 concerning the Implementation of Reproductive Health Efforts so that the provision of contraceptives is clearly limited, controlled, and does not have negative implications for the moral development of students.
