ANALISIS YURIDIS PUTUSAN MAHKAMAH AGUNG NOMOR 707 PK/Pdt/2021 MENGENAI PERBUATAN MELAWAN HUKUM JUAL BELI TANAH MILIK ORANG LAIN

Abstract

Unlawful acts in the matter of buying and selling land due to ownership reasons, the case is in the Supreme Court Decision Number 707 PK / Pdt / 2021. The defendants as the heirs of Lanae Aziz and Lpomale have borrowed and claimed land that does not belong to them, this is based on a lawsuit request from the Tukang Hohakai family, as the plaintiff’s heirs, However, in fact the land in the certificate has been bought and sold with a Sale and Purchase Agreement that does not have proof of ownership, knowing that his land has changed ownership. The plaintiffs as the heirs of Tukang Hohakai feel disadvantaged by this incident, so they cannot own and use the land. The panel of judges decided to reject the plaintiff’s lawsuit in its entirety, so that the disputed object returns to the defendant’s property. Because new facts were discovered that the plaintiffs were proven to have presented false evidence before the trial. The purpose of this study is to find out what is the basis for the judge’s considerations and the legal consequences of the Supreme Court Decision Number 707 PK / Pdt / 2021. The research uses normative legal research, with a statutory approach, concepts and cases sourced from primary and secondary legal materials. The book material collection technique uses a literature study with prescriptive analysis techniques. The results of this study are the
