Abstract
Legalization of business permits for palm oil plantations within forest areas is a controversial policy that provides an opportunity for legitimizing business activities that were previously unlawful under forestry and environmental laws. This thesis aims to examine the legal considerations behind this legalization policy and analyze its juridical implications, both in terms of environmental protection and legal certainty. This research employs a normative method with legislative and conceptual approaches. The findings indicate that the legalization policy, particularly through Articles 110A and 110B of the Job Creation Law, has the potential to create legal uncertainty and weaken the principle of strict liability. Therefore, regulatory harmonization, strict law enforcement, and community involvement in policy oversight are necessary to safeguard forest areas and affected communities.
