ANALISIS YURIDIS PENCABUTAN HAK IMUNITAS JAKSA DALAM PUTUSAN MK NOMOR 15/PUU-XXIII/2025

Abstract

This study analyzes the juridical implications of the revocation of prosecutorial immunity following Constitutional Court Decision Number 15/PUU-XXIII/2025 from the perspectives of the rule of law and the principle of equality before the law. Prosecutors play a crucial role in the criminal justice system and require legal protection to maintain their independence in performing official duties. However, immunity may hinder accountability and create unequal legal treatment. This research employs a normative juridical method using statutory, conceptual, and case approaches. Data are analyzed through legal interpretation of legislation, court decisions, and legal doctrines. The findings reveal that prosecutorial immunity is a form of limited functional immunity rather than absolute protection. The requirement to obtain approval from the Attorney General before initiating legal proceedings against a prosecutor may create conflicts of interest, delay law enforcement, and increase the risk of impunity. The Constitutional Court’s decision seeks to balance prosecutorial independence with accountability and equal treatment before the law. Accordingly, a more limited immunity framework, stronger oversight mechanisms, and clear exceptions are necessary to uphold the rule of law and ensure legal certainty.
