ANALISIS PERAN PARALEGAL DESA DALAM OPTIMALISASI PELAYANAN BANTUAN HUKUM: STUDI KASUS DESA BANDAR

Abstract

The Regulation on Paralegals in the Provision of Legal Aid requires paralegals to complete certified training and perform their duties under the assignment of accredited Legal Aid Providers. However, in Bandar Village, Sukomoro Subdistrict, several village officials have been appointed to provide legal aid services despite not having completed the required paralegal training. This study examines the implementation of non-litigation legal aid services in Bandar Village based on the functions and authority of paralegals, as well as the factors affecting their implementation. The research employs an empirical legal method with a sociological approach, using qualitative analysis to compare legal provisions with field practices and attorneys' perspectives. The findings show that village officials provide initial legal consultations, legal information, and facilitate dispute resolution through deliberation. Nevertheless, these services do not fully comply with the applicable regulations because the officials lack certified paralegal training, legal aid is delivered informally, public understanding of litigation and non-litigation mechanisms remains limited, and no partnership has been established with Legal Aid Providers accredited by the Ministry of Law. These conditions indicate the need for regulatory compliance, capacity building, and institutional collaboration to improve access to legal aid at the village level.
