This study analyzes law enforcement against imported second-hand clothing traders in Surabaya, conducted by the Surabaya City Police, with reference to Law Number 8 of 1999 concerning Consumer Protection. The research is motivated by the prevalence of imported second-hand clothing trade in Surabaya, despite the existence of normative regulations prohibiting such activities. The primary objective of this study is to examine the law enforcement efforts undertaken by the Surabaya City Police and to identify the obstacles encountered in the implementation of these efforts in the field. The study employs an empirical legal research method, utilizing a legal psychology approach. Data were collected through interviews with the Surabaya City Police, the Surabaya Consumer Protection Technical Implementation Unit, and imported second-hand clothing traders in Surabaya. The results indicate that law enforcement against the imported second-hand clothing trade in Surabaya has not been effectively executed. While efforts remain limited to preventive measures such as socialization and public warnings, and have been conducted but have not proven effective. Consequently, the criminal sanctions stipulated in Article 62, paragraph (1) of Law Number 8 of 1999 concerning Consumer Protection have never been applied to imported second-hand clothing traders. The primary obstacles to law enforcement are influenced by concerns regarding the economic impact on traders and high public demand. Based on these findings, it is essential to optimize supervision, enhance inter-sectoral coordination, and implement firm and consistent law enforcement to ensure legal certainty and consumer protection.
