Abstract

From the results contained in the visum et repertum, it will be known about the real condition of the victim. Investigators can conclude whether the elements of the crime of rape have been fulfilled or not and to help investigators decide whether the case settlement process can be continued or not. The research was conducted using a sociological juridical method with a qualitative descriptive approach. Data collection techniques were obtained through interviews with investigators of the PPA unit of Surabaya Police Station and

 the victim's family, as well as through literature study and analysis of case documents. Data validation was obtained through data triangulation techniques and data analysis using descriptive analysis methods with a legal sociological approach. The results of the discussion show that the use of visum et repertum in the disclosure of rape crimes at Surabaya Police Station faces various juridical and sociological challenges. Visum et repertum functions as strong preliminary evidence at the investigation stage and valid evidence at the investigation stage. However, in practice, there is a mismatch between the provisions and reality, which affects the effectiveness of its application. When the visum et repertum results do not show signs of physical violence, alternative strategies taken by investigators include in-depth examination of victims and witnesses, crime scene investigation, and consultation with forensic doctors. The research recommends the need for increased coordination between agencies.
