ANALISIS YURIDIS PUTUSAN MAHKAMAH KONSTITUSI NOMOR 84/PUU-XXII/2024 TENTANG PERPANJANGAN JABATAN NOTARIS

Abstract

The Constitutional Court Decision Number 84/PUU-XXII/2024 amended the retirement age limit for notaries, creating legal issues regarding its implementation, particularly for notaries who had reached retirement age before the decision was pronounced. This study aims to analyze the legal considerations of the Constitutional Court in granting the petition and to examine the legal consequences of the decision for retired notaries. This research employs a normative legal method using statutory and conceptual approaches. Legal materials consist of primary, secondary, and tertiary legal sources analyzed through qualitative and prescriptive methods. The findings reveal that the Constitutional Court based its decision on constitutional protection, developments in professional practice, and objective considerations regarding the capacity of notaries to continue performing their duties. However, although the mechanism for extending a notary's term of office has subsequently been regulated, the decision applies prospectively and does not affect notaries whose terms had expired before the judgment was delivered. Consequently, retired notaries remain ineligible for term extension, giving rise to legal issues concerning the transitional implementation of the new norm and highlighting the need for greater legal certainty in its application.
