Abstract

The advancement of digital technology has encouraged the reform of land administration systems through the implementation of electronic land registration and electronic land certificates in various countries, including Indonesia and Malaysia. However, this transformation raises legal issues concerning the protection of security and the privacy of personal data, which forms a critical component of the electronically stored information. This research aims to analyze the legal protection mechanisms for ensuring data security and privacy in the implementation of electronic land registration systems in Indonesia and Malaysia, while also comparing the advantages and challenges faced by both countries. The research adopts a normative juridical method with a comparative law approach and descriptive analysis based on prevailing legal regulations and official documents from both countries. The findings indicate that both Indonesia and Malaysia have established adequate legal frameworks to support the implementation of electronic land registration systems, including mechanisms for personal data protection. Both countries have also adopted advanced security measures such as blockchain systems and ISO standards for cybersecurity. Nevertheless, weaknesses in implementation remain, including the absence of electronic signatures in Malaysia and infrastructure limitations in Indonesia. In conclusion, although both countries have made significant normative progress in ensuring the security and privacy of personal data, further efforts are required to strengthen regulations, improve digital infrastructure, and raise public awareness in order to ensure effective and comprehensive legal protection.
