A JURIDICAL ANALYSIS OF THE JUDGE’S DECISION IN A PREMEDITATED MURDER CASE (CASE STUDY OF DECISION NO. 1474/PID.B/2019/PN DPS)
Abstract
In certain criminal murder cases, judges may lack thoroughness and depth in issuing verdicts, especially when the available evidence is difficult to interpret. One such example is Decision Number 1474/Pid.B/2019/PN.Dps. The author contends that the panel of judges did not exercise sufficient care in sentencing the defendant. It is believed that the judges failed to adequately consider the facts and evidence presented, and that the witnesses brought forward were ineffective, as they lacked direct knowledge of the actual incident. Using this case as a point of analysis, the researcher aims to examine the accuracy of the verdict issued by the panel of judges, particularly whether it was based on factual findings and trial evidence, as well as whether the sentence imposed on the defendant was appropriate. The study finds that the judges were insufficiently meticulous and attentive in evaluating the facts, material evidence, and witness testimonies presented during the trial.
